Overview

We all think “It’ll Never Happen to Me” but clearly it can, so following the popular presentation at the “Lessons From Failure Seminar” in June by Solicitor Ron Reid of Shoosmiths, Christopher Boocock of R.I.S. and Ron Reid have developed this event which will examine “When Things Go Wrong... What Happens Next?”.

The Seminar will include a series of presentations and practical demonstrations including interview under caution, preliminary hearings and cases for the prosecution and defence.  The delegates will be taken through each step from the incident itself through to a Crown Court Trial and after each step will be asked “what happens next?” before the legal team presents the most probable outcome.

The day will include extracts from a “Mock Trial” with real Lawyers for both the defence and the prosecution cross-examining real witnesses.  A “Judge” summing up and the delegates will be asked for their views as to the likely verdict before any sentence is passed.

This event is designed to provide an insight into the likely operational, reputational and legal issues following a major safety incident and to provide delegates with an understanding of the potential ramifications including:

·         How and why the HSE seek to prosecute

·         Demonstrate how companies and individuals seek to defend themselves

·         Show how a case is brought to a trial in the Crown Court




Attending this event will help you:

·         The recent developments in corporate and personal liability brought about by the Corporate Manslaughter & Corporate Homicide Act 2007 and the Health & Safety (Offences) Act 2008.  Both companies and individuals need to be aware of the potential implications of any incident.

·         The duties of care required of employers and employees towards other employees, contractors & members of the public as well as an insight into the potential ramifications in terms of reputation, lost management time and criminal sanctions that could arise following an incident of this nature.
